Terms of Service
Last updated: 1 January 2026
1. Agreement
By engaging Scarlet Pixel for any service, you agree to these terms. A project begins upon receipt of a signed proposal and deposit payment unless otherwise agreed in writing.
2. Eligibility
Scarlet Pixel works exclusively with clients who are consenting adults operating legally within the laws of their jurisdiction. We do not work with any operation that involves coercion, minors, or activity that is illegal in the client's jurisdiction. We reserve the right to refuse any project without explanation.
3. Payment Terms
A deposit is required before any project work begins. The remaining balance is due upon project completion before the site goes live or files are transferred. Monthly retainers are billed in advance on a recurring basis.
All payments are non-refundable unless Scarlet Pixel fails to deliver the agreed scope. Disputes must be raised within 7 days of delivery.
4. Revisions and Scope
Website projects include up to three revision rounds as standard. Additional revision rounds or scope changes requested after project approval may be quoted separately. The agreed scope is defined in the written project proposal.
5. Client Responsibilities
Clients are responsible for providing accurate information, content, and timely feedback. Delays caused by the client may extend the project timeline without any obligation on Scarlet Pixel's part. Clients confirm they hold rights to any content they provide for use in their project.
6. Intellectual Property
Upon receipt of full payment, the client owns the design and content of their completed website. Scarlet Pixel retains rights to any proprietary frameworks, tools, or codebases used in delivery. We never claim rights over client content.
7. Confidentiality
Both parties agree to keep the details of their working relationship confidential. Scarlet Pixel will never publicly reference a client relationship without explicit written permission. Signed NDAs are available on request.
8. Retainer Cancellation
Monthly retainer agreements may be cancelled by either party with 30 days written notice. No refunds are issued for the current billing period upon cancellation.
9. Limitation of Liability
Scarlet Pixel is not liable for any indirect, consequential, or lost-profit damages arising from the use or performance of any deliverable. Our total liability in any dispute is limited to the fees paid for the specific service in question.
10. Changes to These Terms
These terms may be updated periodically. Continued engagement with Scarlet Pixel after any update constitutes acceptance of the revised terms.
